These terms govern your use of tofmedia.io, which is operated by TOF Media, LLC ("TOF Media," "we," "us"). By using the site, you agree to these terms. If you do not agree, do not use the site.

This site describes TOF Media's services for advertisers and publishers. It is intended for business use.
2. No offer or commitment
Nothing on this site is an offer, a guarantee or a binding commitment. That includes any description of payout models, traffic, volume, quality controls, verticals, results or terms. Every advertiser and publisher relationship is governed solely by a written agreement signed by TOF Media, together with any insertion order under it. If anything on this site conflicts with a signed agreement, the signed agreement controls.
3. Applications
Submitting a publisher application or an inquiry does not create a relationship with TOF Media. We may accept or decline any application at our discretion.
4. Acceptable use
You agree not to:
- use the site for any unlawful purpose;
- interfere with or disrupt the site or its security;
- scrape, copy or harvest content or data from the site by automated means; or
- misrepresent your identity, or any affiliation with TOF Media.
5. Intellectual property
The TOF Media name and logo, and the content of this site, are owned by TOF Media or its licensors and are protected by law. You may not use them without our prior written permission. Other names and marks on the site belong to their respective owners.
6. Third-party sites
The site may link to websites operated by others. We are not responsible for their content or practices.
7. Disclaimer
The site is provided "as is" and "as available," without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the site will be uninterrupted, error-free or accurate.
8. Limitation of liability
To the fullest extent permitted by law, TOF Media will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any lost profits or revenue, arising from your use of the site. Our total liability for any claim relating to the site is limited to one hundred U.S. dollars ($100).
9. Indemnity
You agree to indemnify TOF Media against any claim arising from your misuse of the site or your breach of these terms.
10. Governing law
These terms are governed by the laws of the State of Wyoming, without regard to its conflict-of-laws rules. Any dispute relating to the site will be brought exclusively in the state or federal courts located in Sheridan County, Wyoming.
11. Changes
We may update these terms by posting a new version here with a new effective date. Your continued use of the site after that means you accept the updated terms.
